A LATROBE Valley doctor has pleaded not guilty in the Latrobe Valley County Court to three counts of committing an indecent act with a child under the age of 16.
Thuan Jin Kee faces charges relating to three separate alleged incidents, the prosecution said occurred between 1 February and 3 March 2005.
Dr Kee was then the sole practitioner at Rutherglen Medical in Newborough and assisted at Moe After Hours Medical Service.
In his opening remarks prosecutor Brian Halpin told the court the complainant, whose name has been suppressed, was 14 years old when the alleged offences occurred.
Mr Halpin said Dr Kee told the complainant she was ``beautiful'' and he was a photographer with contacts in the modelling industry.
The court heard Dr Kee took photographs of the complainant on three occasions, including once at Lake Narracan where Mr Halpin said Dr Kee took photos of the girl in wet underwear.
It is alleged the first offence occurred at Dr Kee's Newborough clinic, where he placed both his hands underneath the complainant's school uniform and bra and ``fondled and massaged'' her breasts.
Mr Halpin said that was ``not part of any legitimate medical consultation''.
The second offence was also alleged to have occurred at the clinic, where Mr Halpin said the doctor lay on the floor and simulated a sexual position with the complainant, who could feel his erect penis through her clothes.
The third incident is alleged to have occurred in Melbourne during the 2005 Grand Prix.
Mr Halpin told the jury they would hear evidence Dr Kee massaged moisturising cream into the complainant's inner thighs and buttocks while the two shared a bed.
Con Heliotis QC, for the defence, said his client denied the three charges.
Mr Heliotis told the jury it was important to focus on those charges rather than the many ``uncharged acts'' they would hear about.
He said the photo shoot at Lake Narracan occurred in a ``very public place'' with the knowledge of the complainant's mother, and she was wearing an opaque bra with her dress wrapped around her body ``like a sarong''.
He told the jury they needed to consider whether the first alleged offence occurred within the context outlined by the prosecution.
He told the court Dr Kee said the second alleged event ``never happened'', and the suggestion he slept in the same bed as the complainant and massaged her was ``just nonsense''.
Mr Heliotis told the jury they needed to consider the complainant's behaviour after she went to police in May 2005, and her reasons for making an official complaint.
Yesterday afternoon the court heard the complainant's evidence via a video recorded statement.
The trial continues before Judge Joe Gullaci today.
